These conditions of sale apply to the products of the company L'Atelier de Solène sold on the site www.latelierdesolene.fr operated and put online by the company L'Atelier de Solène.

These terms and conditions of sale apply between the company L'Atelier de Solène and any natural or legal person wishing to make a purchase on the website www.latelierdesolene.fr. The buyer declares that they have full legal capacity.
The conditions applicable to the order of a product by a customer are those in force on the day of the order.

Article 1: Acceptance of the general conditions

The Customer acknowledges having read and expressly accepted the General Terms and Conditions of Sale in effect on the date of the Order, prior to placing their order on the Site. Acceptance of the general terms and conditions of sale is made by the customer confirming their order. By proceeding to payment, the user indicates that they unreservedly accept these general terms and conditions. These conditions are the only ones applicable and prevail over all other conditions.

 

Article 2: The contract

This contract may be updated or modified at any time. The applicable terms and conditions are those in effect on the Atelier de Solène website at the time the order is confirmed. It is therefore necessary to reread them each time you place an order.

 

Article 3: Products

The products offered on the site are those described at the time of consultation by the customer. L'Atelier de Solène undertakes to pay attention to the description of its products and provides as much detail as possible about them. L'Atelier de Solène ensures that the photos reflect reality as faithfully as possible, but slight color nuances may occur. A non-substantial difference may therefore be present on the site, which the customer acknowledges and accepts.

L'Atelier de Solène strives to verify the accuracy of the information published on the website, in catalogs, or in advertisements. However, the company provides no explicit or implicit guarantees regarding the accuracy, reliability, or completeness of such information.

 

Atelier de Solène products are sold while stocks last. In the event of a stock shortage after the order has been confirmed, the customer will receive an email: the order will be canceled and the buyer will be refunded. Given the specific nature of producing its jewelry in limited quantities, L'Atelier de Solène also reserves the right to limit the quantity of products that may be ordered by a customer during a single purchase transaction.

 

Article 4: Prices

The prices displayed on the site are in euros, all taxes included (French VAT and other taxes applicable on the day of the order) but excluding shipping costs (order processing, packaging and delivery).

L'Atelier de Solène reserves the right to modify product prices, but the price charged to the customer will always be the price displayed at the time of order validation, subject to availability. For deliveries abroad, the payment of duties, various taxes, and customs clearance are the customer's responsibility.

 

Article 5: The customer

The customer must be careful to record their personal data and ensure its accuracy. L'Atelier de Solène is not responsible in the event of an inability to deliver the product due to an error by the customer in recording their personal data.

L'Atelier de Solène is not responsible for verifying the client's identity.

 

Article 6: Ordering terms

The customer must follow the various steps set up on the Atelier de Solène website to validate their order.

From the moment the order is validated, the customer accepts all the stipulations and this takes on the value of a contract.

L'Atelier de Solène advises you to carefully check the details of your order before confirming it. These details are available in the "My Account" section.

L'Atelier de Solène reserves the right to refuse or cancel orders at any time for legitimate reasons. Indeed, L'Atelier de Solène may refuse or cancel your order if a dispute arises regarding the payment of the order or a previous order, or if L'Atelier de Solène suspects a violation of the general terms and conditions of sale or any attempted fraud.

Discount codes cannot be combined with each other, nor can they be combined with the use of a gift card.

 

Article 7: Delivery

In accordance with the provisions of article L 121-20-3 of the Consumer Code, the products ordered from Atelier de Solène are delivered, to the extent that stocks are available, within the timeframes indicated on the site from the validation of the order.

The customer will be informed of any delay in delivery of which Atelier de Solène is aware.

Your order will be delivered to the address provided to Atelier de Solène at the time of purchase. You have two delivery options:

- Home delivery (€6 incl. VAT)

- Delivery to a relay point near you (€4.80 incl. VAT)

Deliveries are made by the Colissimo service and are therefore added to the prices of the products invoiced.

If your order exceeds €95 including tax, delivery costs are free in mainland France only.

Shipments of multiple products ordered at the same time may be split depending on product availability.

From the time the order is shipped, the average delivery times are as follows:

- 2 to 5 working days by Colissimo for France;

- 5 to 10 working days by international Colissimo.

If you have not received your order within 10 working days (Monday to Friday) following the maximum waiting time, please contact our customer service at 07 68 84 80 27 or by email at contact@latelierdesolene.com.

We strive to respond to every email within two business days and will do our best to resolve your issue. Be sure to check your spam folder, as our responses often fail there.

If your package is returned to our workshop for one of the following reasons: NPAI (does not live at the address indicated), incomplete address, unclaimed or not received within the allotted time, you will be charged for returning the package.

 

Article 8: Delivery problem due to the carrier

We have chosen to ship our orders with the Colissimo service.

However, as with any shipment, there may be a delay in delivery.

L’Atelier de Solène and the carriers being separate and independent entities,

L'Atelier de Solène cannot be held responsible for any delay or error in delivery or loss of packages attributable to Colissimo.

In the event of a delivery delay compared to the date we indicated in the shipping email, we ask you to notify us of this delay by writing to us at contact@latelierdesolene.com

 

Article 9: Payment

All payments must be made in Euros.

The website www.latelierdesolene.fr offers secure payment by credit card. After confirming the order, the latter will validate it once the payment is made.

The customer guarantees that he or she has the necessary authorizations to use the payment method selected when confirming his or her order. Purchases are debited from the customer's account when the order is processed.

In the event of refusal of authorization of payment by bank card from officially accredited and usual Internet organizations or in the event of non-payment or in the event of non-payment of all or part of a previous order, L'Atelier de Solène reserves the right to suspend all Order management and all delivery.

 

Article 10: Transfer of risks

The risks relating to the products are transferred to the customer at the time when the customer or a third party designated by the latter and other than the carrier takes physical possession of the products.

 

Article 11: Communication

Any communication to be made to the customer will be deemed to have been correctly made if it is made to the electronic or postal address indicated by the customer when concluding the contract.

 

Article 12: Return and refund procedures

Return conditions :

Jewelry purchased in store can only be exchanged or credited within 14 days, not refunded.

On our website, if the customer is not entirely satisfied with the products of L'Atelier de Solène, the latter has a right of withdrawal of 14 days from the day of receipt of his order to return one or more products of the order.

 

If the Order is not returned within the specified time limit, the Order will be deemed final and no refund will be made, except in the cases provided for in these General Conditions of Sale.

Returns must be made in their original and complete condition (jewelry, packaging, accessories). Therefore, damaged, soiled, or incomplete products will not be accepted. Jewelry must not have been worn under any circumstances. Engraved jewelry will not be returned or exchanged.

All returns will be subject to rigorous control by L'Atelier de Solène to ensure that the returned products comply with quality requirements.

The customer organizes the return at his convenience, at his expense and at his risk to the following address:

Upon receipt of the package by Atelier de Solène and subject to these return conditions, we may proceed with an exchange or refund of the order excluding delivery costs, by credit to the customer's bank account or according to the payment method used by the Customer within 14 days following receipt of the package by the seller.

A one-time exchange of a ring from Atelier de Solène for a different size is possible, while stocks last. Beyond this, you will be charged a shipping fee.

Jewelry on sale or with a discount code will also not be exchanged or refunded. When an order also includes a free piece of jewelry with a code, the order cannot be refunded if the jewelry is not returned.

Returns and exchanges are extended to the following January 10th for December orders.

For refunds, the 14-day withdrawal period remains applicable.

 

Article 13: Guarantee and responsibilities

In accordance with article 217-4 of the Consumer Code, L'Atelier de Solène will be liable for any lack of conformity which exists at the time of delivery of the product and which appears within 1 year of this delivery.

If the customer uses the products abnormally or not in accordance with the contract, the consequences resulting from such use are excluded from the scope of the contractual guarantees of Atelier de Solène. The defect will be deemed non-existent if, at the time of conclusion of the contract, the customer was aware of the lack of conformity or could not reasonably be unaware of it or if the lack of conformity is attributable to him.

 

Legal guarantee of conformity

 

The buyer benefits from the legal guarantee of conformity for 1 year in the event of manufacturing defects at the time of purchase.

12-month commercial warranty

We cover the repair or replacement of any damage to the jewelry occurring within 12 months of purchase.

The 12-month warranty does not cover:

1/ The natural aging of the jewel (deposit of impurities on the jewel, natural tarnishing of the metal or stones)

During the life of the jewelry and with daily use, it may happen that impurities get stuck in the pearls, stones, and clasps. In this case, we suggest you clean the jewelry by following our advice.

We would like to point out, however, that in this regard, the particular nature of our products must be taken into account and that the Customer is required to take care of them, in particular by avoiding any contact with detergents or abrasive products (for example, chlorine, salt water, alcohol, perfume, household products, etc.). In addition, normal wear and tear and a certain patina linked to repeated wearing of our products cannot under any circumstances be considered as a lack of conformity within the meaning of this provision. We invite you to read the maintenance and use advice on the site.

 

2/ Wear due to the use of abrasive products.

If the jewelry has been in contact with abrasive products (such as salt water, chlorine, perfume, household products, etc.), the one-year warranty will not apply.

 

3/ Size adjustment (rings, bracelet, necklace)

You bought your ring in the summer, and it becomes a little big in the winter, the chain has loosened a little with use, you want to shorten your necklace, enlarge your bracelet.

These issues but they are not covered by our warranty

 

4/ Lost jewelry

Unfortunately, in the event of lost jewelry, we cannot apply a guarantee.

 

Warranty conditions:

For any warranty support, we will ask you for proof of purchase < 12 months. Our warranty covers purchases on the website www.latelierdesolene.fr and in stores,

Our guarantee does not cover purchases made at clearance sales.

It is agreed that the Customer must notify us of any lack of conformity, in writing, within a maximum period of two weeks from the day on which it discovered the defect. Failure to comply with this obligation will result in the loss of the Customer's rights for lack of conformity.

L'Atelier de Solène only has an obligation of means when using its site by the customer in the context of a consultation or an order and its responsibility cannot be engaged for all the inconveniences or damages inherent to the use of the internet network, an external intrusion or any case of force majeure beyond its control.

 

Warranty & non-warranty conditions :

All our jewelry is guaranteed for 1 year against any manufacturing defect. During this period,

L'Atelier de Solène undertakes to take care of the repair of jewelry (excluding costs

shipping). After this period, we offer a repair service mentioning a cost.

 

Repair times:

Classic repair (clasp, chain, stone, etc.) : 1 to 3 weeks .

Re-gilding : 1 month minimum.

 

One-year out-of-warranty repairs:

A clip, a stone/pearl, a broken or damaged part : between €3 and €5.

Re-gilding : between €10 and €15 (this service is subject to validation by our

workshops).

 

Article 14: Personal data

The Client is informed and accepts that his/her personal data may be collected by L'Atelier de Solène, which acts as data controller within the meaning of Law 78-17 of 6 January 1978 relating to Information Technology, Files and Liberties as amended on 20 January 2017 [and as it will be amended by the General Data Protection Regulation 2016/679 dated 27 April 2016, applicable from 25 May 2018].

• Collection and use of personal data:

“Personal data” refers to information about you as a natural person that you voluntarily provide when making a purchase on the site, or that L'Atelier de Solène collects as part of your browsing and which allows you to be identified, directly or indirectly.

Personal data includes personal data (such as your name, contact details) and electronic identification data available on or from your computer (“cookies” or “IP addresses”).

Customers' personal data is collected for the following purposes:

- management of Orders and relations with Customers;

- information for Customers relating to offers and commercial information related to the brand;

- strengthening and improving communication about the Website and the brand by sending, in particular, newsletters and special offers based on the Customer's preferences noted on the Website;

- the improvement and personalization of the services offered to Customers; and

- compliance with legal and regulatory obligations.

They are intended for the departments responsible for order management and online marketing (newsletters).

• Duration of retention of personal data

The Client's personal data will be kept for the entire duration of use of the service.

• Rights of data subjects regarding the data collected

In accordance with applicable regulations regarding personal data, you have the right to access, rectify, oppose, limit the processing, erase and transfer your data.

Each request must be signed and accompanied by a photocopy of both sides of an identity document bearing the Client's signature and specifying the applicant's name, first name and reply address.

The response to the request made on the basis of one or more Data Protection Rights will be sent within one month of receipt of the request.

The Client may provide L'Atelier de Solène with specific instructions in which he or she defines the manner in which he or she intends that the Data Protection Rights and Freedoms be exercised after his or her death in accordance with the Data Protection Act.

• Security measures

L'Atelier de Solène undertakes to protect and ensure the security and confidentiality of its Clients' personal data in accordance with the Data Protection Act, in particular by taking all necessary precautions to prevent this data from being distorted, damaged or accessed by unauthorized third parties.

In the event of a personal data breach, L'Atelier de Solène will notify the CNIL of the breach in question as soon as possible. If the personal data breach is likely to pose a high risk to a Client's rights and freedoms, L'Atelier de Solène will inform the data subject of the personal data breach as soon as possible.

• Use of data in the event of a change of control of the company

The data collected by L'Atelier de Solène may be transferred to third parties in the event of a change of control of the company, an acquisition, collective proceedings or a sale of the company's assets.

• Personal data policy relating to minors

Access to the Site is not reserved for adults because it does not contain content prohibited for minors under 18 years of age.

The Site's forms and questionnaires are not intended to collect information about minors. If information about a minor is collected through the Site, the minor's legal representative will have the option to contact L'Atelier de Solène's Customer Relations Department to correct, modify, or delete this information.

• Update of the personal data policy

L'Atelier de Solène may modify its Personal Data Policy at any time.

If L'Atelier de Solène wishes to use your personal data in a manner different from that stipulated in the Personal Data Policy in effect at the time of collection, these changes will be published in a new version of this Personal Data Policy.

Due to changes that may occur in the Personal Data Policy, the customer undertakes to regularly visit the “Personal Data” section of the general terms and conditions of sale.

 

Article 15: Waiver

No waiver on our part of any of our rights may be inferred except from the express, certain and written expression to that effect.

 

Article 16: Reservation of ownership

The Products remain the property of L'Atelier de Solène until full payment of the Order price. No dispute regarding the delivery itself is possible if the package appears to have been delivered, the carrier's computer system or the signature of the delivery slip being proof.

 

Article 17: Proof and Conservation and archiving of transactions

L'Atelier de Solène recommends that the customer keep a paper record or a reliable electronic medium of all data relating to their order.

The computerized records, stored in the L'Atelier de Solène computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the Parties.

 

Article 18: Competent jurisdictions

These general terms and conditions of sale comply with French law. In the event of a dispute, the French courts within the jurisdiction of the Paris Court of Appeal shall have sole jurisdiction.

Any Order from a Customer entails on their part the explicit and irrevocable waiver of any action of any nature whatsoever which does not fall under the exclusive jurisdiction of French law.
